Agreement to Terms
By accessing and using HireFractional ("the Platform"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the service.
Description of Service
HireFractional is a marketplace connecting fractional executives (CFOs, CTOs, CMOs, COOs) with startups and companies seeking part-time executive talent. We provide a platform for profile creation, discovery, and initial connection. We do not employ executives or guarantee specific outcomes.
Executive Accounts
Registration
To create an executive profile, you must:
- Provide accurate and complete information
- Have relevant executive experience
- Be at least 18 years old
- Maintain only one active account
Account Responsibilities
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Keeping your profile information accurate and up-to-date
- Notifying us immediately of any unauthorized use
Subscription and Payments
Pricing
We offer three subscription tiers: Standard ($99/month), Featured ($299/month), and Elite ($599/month). Prices are subject to change with 30 days notice.
Billing
- Subscriptions are billed monthly in advance
- Payment is due at the start of each billing cycle
- No refunds for partial months
- Failed payments may result in service suspension
Cancellation
You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. No refunds will be issued for the current billing cycle.
Content and Conduct
Your Content
You retain ownership of your profile content. By posting content, you grant us a worldwide, non-exclusive, royalty-free license to display, distribute, and promote your profile within the Platform.
Prohibited Conduct
You may not:
- Post false, misleading, or fraudulent information
- Impersonate another person or company
- Use the Platform for spam or unsolicited marketing
- Scrape or data mine user information
- Interfere with the Platform's operation
- Violate any applicable laws or regulations
Independent Contractor Relationship
HireFractional is a marketplace platform only. All engagements between executives and companies are independent contractor relationships. We are not a party to these agreements and assume no liability for work performed or payments made.
Intellectual Property
The Platform, including its design, features, and content (excluding user-generated content), is owned by HireFractional and protected by copyright, trademark, and other intellectual property laws.
Disclaimers
THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE SPECIFIC RESULTS, CONNECTIONS, OR REVENUE. WE ARE NOT RESPONSIBLE FOR THE QUALITY OF WORK PERFORMED OR DISPUTES BETWEEN EXECUTIVES AND COMPANIES.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HIREFRACTIONAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.
Indemnification
You agree to indemnify and hold HireFractional harmless from any claims, losses, or damages arising from your use of the Platform, violation of these Terms, or infringement of any third-party rights.
Termination
We reserve the right to suspend or terminate your account at any time for violations of these Terms, fraudulent activity, or at our discretion. Upon termination, your right to use the Platform ceases immediately.
Dispute Resolution
Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive your right to participate in class action lawsuits.
Governing Law
These Terms are governed by the laws of [Your State/Country], without regard to conflict of law principles.
Changes to Terms
We may modify these Terms at any time. Significant changes will be communicated via email. Continued use of the Platform after changes constitutes acceptance of the new Terms.
